In 2019, there were 5,014 fatal motorcycle accidents in the United States; 591 of those fatal accidents occurred in Florida. According to the National Highway Traffic Safety Administration, the only states that come close are California with 474 fatal motorcycle accidents and Texas with 416. The fourth highest was much lower. It was North Carolina with 208 motorcycle accident fatalities.

The Insurance Information Institute has found that motorcyclists are five times more likely to be injured in an accident and 29 times more likely to be fatally injured in an accident than in any other vehicle. The reason is because of the lack of safety features on a motorcycle. There are no airbags, seatbelts, or steel frames of a car to protect them from the road.

Motorcyclists were at fault in less than 26% of the accidents they were involved in. Accidents are most often the result of the other driver’s negligence. Factors cited include speeding, texting, and distracted or impaired driving.
4. Florida’s Comparative Negligence Law Means They May Receive Compensation Even When at Fault
The comparative negligence laws in Florida provide that the amount of compensation paid will be reduced by the percentage of negligence attributable to the claimant. For example, if a motorcyclist is found to be 25% responsible for the accident, they can only receive 75% of the compensation awarded by a judge or jury.
