What to Do If You Suspect Nursing Home Abuse

If you have a loved one in a nursing home, you should know the different types of abuse that commonly occur in nursing homes as well as how to spot the signs of nursing home abuse and where to get help if needed.

How to Spot the Signs of Nursing Home Abuse

The signs of nursing home abuse will vary depending on the type of abuse. These are the most commonly reported types and signs they are occurring.

Physical abuse

Common signs of physical abuse include cuts, burns, abrasions, bruises, and fractured or broken bones.

Emotional abuse

Common signs that your loved one suffers emotional abuse include being emotionally upset, withdrawn, agitated, confused, or scared. Emotional abuse can include threats, intimidation, neglect, and isolation.

Neglect

Failing to provide medical care, food, water, clothing, shelter, and other essential care is considered neglect. Neglect victims may appear dehydrated or malnourished, have bed sores, or show signs of restraint. Wandering can also be considered neglect if proper supervision is not provided by nursing home employees.

How to Report Nursing Home Abuse

Reporting nursing home abuse must be done through the proper channels; if no action is taken, you can escalate your claim.

Nursing Home Administrator

Suspected nursing home abuse or neglect should always be reported to the nursing home administrator in writing.  

Florida Agency for Healthcare Administration

If the nursing home administrator fails to respond or you are dissatisfied with the response, you can file a report with the State of Florida’s Agency for Healthcare Administration here.

Florida Long-Term Care Ombudsman Program

According to its website, “The Long-Term Care Ombudsman Program (LTCOP) is a statewide, volunteer-based system of local units that act as advocates for residents of long-term care facilities. Through 13 district offices that together cover the entire state, volunteers work with staff to identify, investigate, and resolve complaints made by, or on behalf of, residents of nursing homes, assisted living facilities, adult family-care homes, and continuing care retirement communities.”  Read more about the LTCOP here.

Florida Department of Health and Adult Protective Services

Florida’s Department of Health investigates complaints and reports involving healthcare practitioners. Complaints may result in administrative action against health care practitioners such as a reprimand, fine, restriction of practice, remedial education, administrative cost, probation, license suspension or license revocation.  Follow this link to file a complaint.

Sometimes life takes an unexpected turn, and you find yourself grappling with the aftermath of a serious injury, After my accident I called Nick before becoming his client and he offered me valuable advise that protected me and helped me navigate the aftermath of a horrific accident on I-95. Exceptional!! The complexity of this case intiially appeared to be cut and dry. Boy was I wrong. Casas Law is the very best. I got hit by a car while riding my bicycle. I had a ton of problems physically and also was pretty mentally down from the accident. Luckily, all I had to focus on was my recovery. I never thought I would need a personal injury attorney, but sometimes life happens. I heard many stories about what people have gone through after being injured and I was quite nervous about the process. I was referred to Alejandro (Alex) Casas by a friend. Throughout the process Alex was very professional, compassionate, explained things very clearly and took the time to listen to me. His office staff was always there to answer questions. I never had to wait long for an answer about anything. Casas Law did not try to micromanage my choice in health care providers, but did have a lot of knowledge about local providers if I needed recommendations. A friend of mine was coerced into seeing certain practitioners for care by her attorney. That did not happen to me. Alex and his team were my rock after I was hit by a car while riding my bike.
